Requests for information on our training offers (hereinafter the” Services ”), the subscription to the Services or the visit and use of our website www.lingueo.com (hereinafter the” Site ”) may involve the Processing of personal data, defined as information that makes it possible to identify a natural person directly or indirectly (Hereinafter the” Personal data ”), according to the terms and conditions detailed in this privacy policy (Hereinafter the” Treatment ”).

1.1.3. Personal Data (Contact) may also be the result of a training request that you made on the site. www.moncompteformation.gouv.fr or communicated by a LINGUEO partner company.

1.1.4. You are also informed that your telephone conversations with LINGUEO staff regarding your requests for information on the Services may be recorded (Hereinafter the” Recordings ”).

1.2. Data collected for the purposes of subscribing to and benefiting from the Services:

The Personal Data that is collected in order to subscribe to the Services, to allow you to create your personal account on the Site and to follow the training courses, are:

- Data necessary for your identification and the creation of your personal account on the Site, namely: your name, first name, identifiers (ID) generated by LINGUEO, gender (feminine/masculine), e-mail address, the legal name of the company in which you exercise your professional activity if applicable and, if you wish, your telephone number and your photograph;

1.3.2. The functional Cookies that make it possible to optimize and personalize the consultation of the Site are the following:

This data can also be used to send you offers and commercial information by email, only if you have given us permission to do so, the Processing then having as a legal basis your consent.

3.2. The processing of student Personal Data has the following legal bases:

- The execution of the contract between you and LINGUEO, namely the general conditions of use of the moncompteformation.gouv.fr website

(https://www.moncompteformation.gouv.fr/espace-public/conditions-generales-dutilisation) if you subscribe to the services as part of the use of your Compte Personnel de Formation (CPF) or the general conditions of use of the Site otherwise.

- The legitimate interest of LINGUEO consisting in improving its Services, preventing fraud,
optimize the management of personal space and produce statistics;

- Compliance with a legal obligation (Arts. L.6353-1, D.6353-1 and L.6113-1 of the Labor Code); Student Personal Data is processed only for the sole purpose of pursuing the legitimate interest objectives referred to above, offering Services in line with your expectations, managing the financing of your courses, and issuing end-of-course certificates and LILATE certificates, if applicable.

3.3. The legal basis for the Processing of Personal Data collected via the Cookies listed above is consent.

4. Storage duration:

4.1. Personal Contact Data is kept for a period of three (3) years from their collection or the last contact you had with LINGUEO.

4.2. Recordings are kept for a maximum of six (6) months.

4.3. Student Personal Data is kept for the duration of the contract between you and LINGUEO, with the exception of:


- Personal data necessary for the issuance of the “LILATE” certificate, which are kept for the period of validity of the said certificate and then can be archived in accordance with applicable legislative or regulatory provisions;

- Connection logs and event logs, kept for 6 months.
 
4.4. The retention periods for Cookies are detailed below:


- CRISP, Retention period: Until the closure of the support ticket for requests involving complaints, or at the end of the conversation in the case of a simple assistance request, Interim archiving period: 5 years from the request for assistance;

- GOOGLE ANALYTICS, Retention period: 25 months.

5. Recipients of Personal Data:

5.1. Personal Contact Data, Records and Cookies are only intended for authorized LINGUEO personnel and are not communicated to third parties.


5.2. Student Personal Data is intended for authorized LINGUEO staff and may be communicated in part:

- To language teachers, with regard to the data necessary for the implementation of your training;

- To the company that has subscribed to the Services from which you benefit, if applicable, in terms of level, attendance and progress data;

- To the Caisse des Dépôts et Consignations, if you have subscribed to the services as part of the use of your professional training account;

- To France Compétences, an organization with which the LILATE certificate is registered.

6. Exercise of rights:

6.1. You have the option, by writing to the email address contact@lingueo.com, of:

- Exercise a right of access, in order to know the Personal Data concerning you as well as the information mentioned in article 15 of the RGPD;


- Request that Personal Data concerning you, which would be inaccurate or incomplete, be rectified under the conditions provided for in article 16 of the RGPD;

- Request that the Personal Data concerning you be deleted under the conditions provided for in article 17 of the RGPD;

- Request the limitation of Personal Data concerning you under the conditions provided for in article 18 of the RGPD;

- Concerning Student Personal Data whose legal basis for Processing is the execution of the contract: receiving them in a structured, commonly used and machine-readable format, transmitting this data to another data controller or even obtaining that this data be transmitted directly to another data controller, if this is technically possible;

- File a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL).

6.2. With regard to Contact Personal Data, Student Personal Data whose legal basis is the legitimate interest of LINGUEO and Recordings, you have the possibility to object, for reasons relating to your particular situation, to their processing, by
writing to the email address mentioned above.

6.3. You finally have the opportunity to:
- Withdraw your consent to receive offers and information from LINGUEO by email at any time by writing to the email address mentioned above or by clicking on the link” unsubscribe ” at the bottom of each email;
- Manage your preferences and withdraw your consent to the Processing of Cookies by clicking on the “I choose” tab;

LINGUEO implements the organizational, technical, software and physical measures necessary to maintain the confidentiality, integrity and security of Personal Data and in particular to prevent them from being deformed, damaged or communicated to unauthorized persons.
